The following General Conditions of Sale govern the offer and sale of products on this website\u00a0www.mygrappa.it<\/strong><\/a><\/p>

The products purchased on the Site are offered and sold by DIS SRL DISTILLERS & DISTRIBUTORS<\/strong>\u00a0, registered office Viale Martiri della Benedicta, 51, capital soc.\u00a060,000 euros fully paid-up, CF \/ VAT number 01471690998, Cam.Com GE-411815, (hereinafter referred to as DIS)<\/p><\/div><\/div>

1. SCOPE OF APPLICATION<\/h5>

1.1 The General Conditions of Sale can be changed at any time.\u00a0Any changes and \/ or new conditions will be effective from the moment of their publication on the Site.\u00a0For this reason, users are invited to access the Site regularly and to consult, before making any purchase, the most updated version of the General Conditions of Sale.\u00a0The applicable General Conditions of Sale are those in force on the date the purchase order is sent.<\/span><\/p>

2. PURCHASES ON THE SITE<\/h5>

  • to conclude the purchase contract for one or more Products on the Site, the user must fill in an order form in electronic format and transmit it to\u00a0DIS<\/strong>\u00a0, electronically, following the instructions that will appear from time to time on the Site and which will accompany the different stages of the purchase;<\/li>
  • the contract is concluded when the order form reaches the\u00a0DIS<\/strong>\u00a0server;<\/li>
  • once the order form has been registered,\u00a0DIS<\/strong>\u00a0will send the user, via e-mail to the e-mail address indicated, the order confirmation, containing information relating to the characteristics of the purchased Product, a detailed indication of the price, the means of payment used, the delivery costs and any additional costs as well as the contacts of the Customer Service, which the user can contact to request assistance and \/ or submit complaints.\u00a0It is recommended to keep the e-mail received as proof of purchase.\u00a0The General Conditions of Sale and the information on the right of withdrawal, as well as the\u00a0DIS<\/strong>\u00a0Privacy Policy, will be available on the pages of the website.<\/li>
  • the order form will be filed in the DIS<\/strong>\u00a0database\u00a0for the time necessary to process the order and, in any case, in accordance with the law.\u00a0To access their order form, the user can consult their account.<\/li><\/ul>
    5. VALIDITY OF OFFERS AND PRICES<\/h5>

    5.1 All Product prices are expressed in Euros (\u20ac) and are inclusive of Value Added Tax (\u201cVAT\u201d), unless otherwise specified.\u00a0Any additional cost will be expressly and separately indicated in the order form, before the user proceeds with the transmission of the same.
    5.2 The price of the Products can be modified by\u00a0DIS<\/strong>\u00a0at any time, without notice, it being understood that the price charged to the user will be the one published on the information sheet that illustrates the main characteristics of the Product\u00a0(Product Sheet)<\/strong>\u00a0at the time of sending the order.\u00a0Any price changes (increase or decrease) subsequent to the transmission of the order will not be taken into account.<\/p>

    6. PURCHASE ORDERS \u2013 PRODUCT INFORMATION<\/h5>

    6.1 The prices, descriptions or availability of the products displayed are subject to change without notice.\u00a0If an ordered item is not available, the Owner will immediately inform the customer and will refund any price already paid.
    6.2 DIS<\/strong>\u00a0will process the purchase order, and therefore will ship the purchased Product, with the exception of orders for which the Customer has chosen \u201ccash to courier\u201d as the payment method, only after receiving confirmation of the authorization to the payment of the total amount due, consisting of the purchase price, the delivery costs, if applicable, and any other additional cost, as indicated in the order form\u00a0(Total Amount Due)<\/strong>\u00a0.In the event that the Total Amount Due is not paid or the successful outcome of the payment is not confirmed, the purchase contract will therefore be considered terminated by law pursuant to and for the purposes of art.\u00a01456 cc
    6.2 The Products will remain the property of\u00a0DIS<\/strong>\u00a0until payment of the Total Amount Due has been made by the user.\u00a0The risk of loss or damage to the Products, for reasons not attributable to\u00a0DIS<\/strong>\u00a0, on the other hand, will be transferred to the user when the user, or a third party designated by the same and different from the carrier, materially comes into possession of the Products.
    6.3 Each Product is accompanied by a Product Sheet.The images and descriptions on the Site reproduce the characteristics of the Products as faithfully as possible.\u00a0Furthermore, the images of the Product present in the Product Sheet may differ by year and \/ or size or in relation to any accessory products.\u00a0These images must therefore be intended as indicative and with the tolerances of use.\u00a0For the purposes of the purchase contract, the description of the Product contained in the order form sent by the user will prevail.<\/p>

    7. DELIVERY OF PURCHASED PRODUCTS<\/h5>

    7.1 Delivery times are always indicated in the sheet of each product, during the payment phase and on the order confirmation email.\u00a0Generally the shipment takes place within 48H.
    Deliveries are made during normal working hours to the address indicated by the User, through a carrier throughout the Italian territory.\u00a0The carrier assumes full responsibility for the transport, from taking charge to delivery to the address you have indicated.
    In case of failure to collect within the deadline set by the carrier, the products will be returned to the Owner, who will refund the price of the products.The Owner cannot be held responsible for errors in delivery due to inaccuracies or incompleteness in the compilation of the purchase order by the User, nor for delays in shipment or damage that may have occurred to the products after delivery to the carrier, where the latter \u2018 last has been chosen and appointed by the User.
    7.2 The shipments of orders placed on the mygrappa.it website will only be possible in Italy.<\/p>

    8. METHOD OF PAYMENT<\/h5>

    8.1 The payment of the Products can be made by credit card, through the PayPal payment solution or by bank transfer.\u00a0In the event that one of these payment methods \/ solutions cannot be used in relation to a specific Product, this will be clearly indicated on the Site, at the latest at the beginning of the purchase procedure.
    8.2 Payment by credit or debit card<\/strong>
    8.2.1 Payment for the Products can be made by credit or debit card directly through the Site.
    8.2.2 Confidential credit card data (card number, holder, date of expiration date, security code) are encrypted and transmitted directly to the payment manager without passing through the servers used by\u00a0DIS<\/strong>\u00a0.\u00a0DIS<\/strong>therefore never has access to and does not store the data of the credit card used by the user to pay for the Products (even if the user has decided to store the credit card data on the Site), with the exception of the name of the credit card holder.
    8.3 Payment by PayPal payment solution<\/strong>
    8.3.1 Payment for Products purchased on the Site can be made using the PayPal payment solution.\u00a0If the user chooses PayPal as a means of payment, he will be redirected to the website www.paypal.it where he will pay for the Products according to the procedure provided and governed by PayPal and the terms and conditions of the contract agreed between the user and PayPal.\u00a0The data entered on the PayPal site will be processed directly by the same and will not be transmitted or shared with\u00a0DIS<\/strong>.\u00a0The latter is therefore unable to know and does not store in any way the data of the credit card connected to the user\u2019s PayPal account or the data of any other payment instrument connected with this account.
    8.3.2 In the case of payment by PayPal, the Total Amount Due will be charged by PayPal to the user at the same time as the conclusion of the contract through the Site.\u00a0In the event of termination of the purchase contract and in any other case of reimbursement, for any reason, the amount of the refund due to the user will be credited to his PayPal account, unless otherwise agreed between the User and\u00a0DIS<\/strong>\u00a0.\u00a0The credit times on the payment instrument connected to this account depend exclusively on PayPal and the banking system.Once the credit order has been placed in favor of this account,\u00a0DIS<\/strong>\u00a0cannot be held responsible for any delays or omissions in crediting the user with the refund amount, to contest which the user must contact directly to PayPal.
    8.4 Bank transfer
    8.4.1 If the user decides to pay by bank transfer, the order will be shipped as soon as\u00a0DIS<\/strong>\u00a0has received the credit of the amount relating to the order.<\/p>

    9. RIGHT OF WITHDRAWAL<\/h5>

    9.1 The user who acts as a consumer has the right to withdraw from the contract concluded with\u00a0DIS<\/strong>\u00a0without incurring costs other than those indicated in this article and without having to specify the reason, within fourteen (14) calendar days\u00a0(Withdrawal Period)<\/strong>\u00a0.\u00a0The Withdrawal Period expires after 14 days:
    9.2.\u00a0To exercise the right of withdrawal, the user must inform\u00a0DIS<\/strong>\u00a0of his decision to withdraw, before the expiry of the Withdrawal Period.
    9.3 To exercise the right of withdrawal, the user must send a request by e-mail to info@mygrappa.it
    9.4 To return the Product, the user can use a\u00a0carrier of their choice with return costs charged to the user: in this case , the user<\/strong>, after having exercised the right of withdrawal in the manner indicated in this article, must return the Product to DIS, using a carrier at at its own choice and at its own expense, without undue delay and in any case within the term of 20 calendar days from the date on which it communicated\u00a0its decision to withdraw to\u00a0DIS.\u00a0<\/strong>The deadline is met if the user returns the Product before the expiry of the fourteen-day period.\u00a0The Product, properly protected and packaged, must be sent to the following address:

    9.5 If the user withdraws from the contract,\u00a0DIS<\/strong>\u00a0will refund the Total Amount Due paid by the user for the Product, without undue delay and in any case no later than 14 calendar days from the day\u00a0DIS<\/strong>\u00a0received the Products subject to withdrawal in the same conditions in which they were sold.\u00a0The refund will be made using the same payment method used by the user for the initial transaction or the different means agreed between the parties;\u00a0in any case, the user will not have to bear any additional costs as a consequence of this refund.<\/p>

    10. MISCELLANEOUS<\/h5>

    10.1 DIS is a registered trademark.\u00a0Photos, texts, descriptions and everything contained in the Site are the property of\u00a0DIS<\/strong>\u00a0.\u00a0The full or partial reproduction of any part of the Site is prohibited;\u00a0it is also forbidden to reproduce texts or photos for any use and in any form and in any case without the prior written authorization of\u00a0DIS<\/strong>
    10.2\u00a0DIS<\/strong>\u00a0is not responsible for any damage suffered by the user or third parties or to things owned by the user or third parties.\u00a0due to delays in delivery or related to the use of the Product.<\/p>

    11. LEGAL GUARANTEE OF CONFORMITY<\/h5>

    11.1 The User who purchases as a consumer has the right to guarantee the products and services purchased within the limits of 24 months from the purchase and under the conditions established by law, provided that the Owner is notified of the defects found, with the same procedures for withdrawal, within 2 months of their discovery.
